Criminal conduct relating to designs
There is certain conduct that is prohibited in relation to registered designs. This means that you commit a criminal offence if you do any of the following:
- Make or cause a false entry to be made in the Register;
- Make or cause any forgery of any entry in the Register;
- Produce or tender as evidence in Court any falsified entry in the Register whilst knowing it is falsified;
- Make any false statement or representation to deceive the Registrar or any officer of CIPC;
- Make any false statement or representation to influence anything concerning the Designs Act;
- Represent (including just by selling any article, which is marked in such a way) that there is a registered design in respect of any article, or that any article is the subject of an application for the registration of a design, if this is false.
Read sections 47–49 of the Designs Act.
